PRAYER:Writ Petition is filed under Article 226 of the Constitution of India, to issue a writ of Mandamus, to direct the respondents to pay Voluntary Retirement compensation amount along with the interest at the rate of 18% per annum and also for the belated payment of retirement benefits including Earned Leave Salary, Provident Fund and Commutation. ORDER
The instant writ petition has been filed by an employee of the respondent transport corporation, who was permitted to go on voluntary retirement on 30.06.2022, seeking a mandamus for payment of interest due to the belated disbursement of the terminal benefits. 2.Though the petitioner was permitted to go on voluntarily retirement on 30.06.2022, his terminal benefits have been released only on 30.05.2023. Hence, the petitioner has sent a representation to the respondents on 14.06.2024, seeking interest for the belated disbursement. However, there is no response, the present writ petition has been filed. 2/5
3.According to the learned Counsel appearing for the petitioner, he has not been paid voluntary retirement compensation. Though other terminal benefits have been released, they have been released belatedly. 4.Considering the above said facts, the respondent authorities are directed to release eligible voluntarily retirement compensation along with 6% interest from the due date till the date of disbursement. As far as the other terminal benefits are concerned, the respondents are directed to pay 6% interest from the due date till the date of disbursement. The said exercise shall be completed within a period of twelve weeks from the date of receipt of a copy of this order.
5.With the above said observations, this writ petition stands disposed of. No costs.
