For Respondent : Mr.R.MEENAKSHI SUNDARAM, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.26 of 2021 on the file of the Respondent police.

ORDER : The Court made the following order :- The petitioner/Accused No.1, who apprehends arrest at the hands of the respondent police for the offences punishable under sections 109 & 506 (I) of IPC and Sections 5 (1) & 6 of Protection of Child from Sexual Offences Act, 2012, in Crime No.26 of 2021 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that at the time of occurrence, the petitioner is aged about 20 years and the victim girl is aged about 14 years. On 16.10.2021, he had committed sexual assault on her by threatening. Hence, the complaint. 3.The learned counsel for the petitioner would submit that the petitioner is innocent and he has not committed any offence as alleged by the prosecution. He would further submit that the petitioner and the victim girl loved each other and she voluntarily went to the house of the petitioner. Hence, he seeks anticipatory bail.

4.It is the specific case of the prosecution that the victim girl is 14 years and the petitioner/accused is 20 years and the investigation is yet to be completed.

CRL OP(MD). No.18625 of 2021 5.Considering the seriousness and gravity of the offence alleged and also considering the facts that the victim girl is only 14 years and that the investigation is pending, this Court is not inclined to grant anticipatory bail to the petitioner at this point of time.

6.In view of the above, this Criminal Original Petition is dismissed.
