Prayer: Writ petition filed under Article 226 of the Constitution of India, to issue a Writ of Declaration, declaring the written examination held on 29.03.2015 which was conducted by the respondent to the post of Assistant is perse illegal and conduct a fresh examination.

ORDER

The relief sought for in the present writ petition is to declare the written examination held on 29.03.2015 conducted by the respondents to the post of Assistant is per se illegal and conduct a fresh examination.

2.The counter affidavit filed on behalf of the respondent states that the petitioner is neither qualified nor found eligible under the categories of backward class community and his application has not been considered by the respondent Bank. Thus, the petitioner has not been called for the written examination conducted by the respondent Bank on 29.03.2015. It is made clear that the petitioner is not qualified and not permitted to write the examination. The examinations were conducted in the year 2015 itself and the process of selection were concluded. Thus, the relief as such sought for to declare the written examination held on 29.03.2015 cannot be granted as the cause does not exist as of now. Thus, the petitioner is at liberty to approach the competent authorities under the provisions of the Tamil Nadu Co-operative Societies Act.
