Criminal Original Petition filed under section 482 of Criminal Procedure Code, to pass an order for to transfer the case in S.C.No.78 of 2017 pending before the learned Additional District Court, Dindigul District, in Crime No.467 of 2015 dated 07.05.2015 on the file of the first respondent to any other competent Court outside Dindigul District.

This petition has been filed to transfer the case in S.C.No.78 of 2017 pending before the learned Additional District Court, Dindigul District, in Crime No.467 of 2015 dated 07.05.2015 on the file of the first respondent to any other competent Court outside Dindigul District.
2. The petitioner is arrayed as fourth accused. He was threatened by the defacto complainant with the dire consequences. Therefore, he could not even appear before the trial Court. Therefore, he also lodged a complaint before the Registrar of this Court and other higher officials for taking further action.
3. The learned Government Advocate (Crl.Side) would submit that there are totally nine accused. In which, no one was appeared https://hcservices.ecourts.gov.in/hcservices/ 1/2
Crl.O.P.(MD)No.11381 of 2018 before the Court below for the past one year. Thereafter, all the accused were present before the Court below and the Court below framed the charges as against them and posted the matter for trial. Therefore, no one threatened the petitioner at any point of time. 4.Therefore, this prayer cannot be considered by transfer of the case to the other Court. Accordingly, this Criminal Original Petition is dismissed. Consequently, connected miscellaneous petitions are closed.
5. However, the petitioner is at liberty to lodge a fresh complaint before the concerned jurisdictional Police Station, if he faces any threaten.
