ORDER
The present Writ Petition has been filed for the issuance of a Writ of Certiorarified Mandamus, to quash the impugned order and consequently direct the register the petitioner's sale deed.
2. Through the impugned order, the respondents have refused to register the sale deed stating that the petitioner has purchased the plots which are unapproved plots.
3. The learned counsel for the petitioner however submitted that eventhough it is unapproved plots, several documents were registered right from 2009 onwards. Infact in the impugned order itself, the respondents had admitted several documents were registered from the year 2009 to 2021. When substantial portion of the land has already been sold, the respondents cannot seek for fresh lay out approval. This issue is already settled by this Court in several writ petitions. Therefore, the impugned order shows the non-application of mind and liable to be quashed. Accordingly, the impugned order is quashed. The respondents are directed to register the sale deed presented by the petitioner within a period of four weeks from the date of receipt of a copy of this order. 2/4
4. Accordingly, this Writ Petition is allowed. There shall be no order as to costs.
