Respondent/Respondent/ Petitioner Prayer :- This Criminal Revision case filed under section 397 R/W 401 Cr.P.C., to call for the records and set aside the order passed dt.31/8/2021 made in Crl.MP.No.1495/2019 in MC No.64/2017 on the file of the Chief Judicial Magistrate,Thanjavur at Kumbakonam. ORDER:- This Criminal Revision Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and earlier order of this Court and the letter submitted by the Chief Judicial Magistrate, Thanjavur at Kumbakonam, vide her letter D.No. 843/2023/MC, Dated 29.03.2023, requesting for further period of 3 months to dispose the case, this court made the following order :

Today, this case is listed under the caption for "Extension of Time for Lower Court".

2. It is seen from the records that this Court, vide order dated 10.03.2022, directed the trial Court to take necessary steps for DNA test for the petitioner as well as for the respondents and to complete the trial within a period of three months from the date of receipt of that report.

3. The learned Chief Judicial Magistrate, Thanjavur at Kumbakonam has submitted a requisition dated 29.03.2023 stating that the DNA report was received on 24.11.2022 and that two witnesses have already been examined on the said of the respondent and the case is now stand posted for the respondent side evidence and seeks three months further time to dispose of the case. https://www.mhc.tn.gov.in/judis 1/2

4. Considering the reasons assigned, this Court is inclined to grant the time as sought for by the learned Chief Judicial Magistrate. Accordingly, three months further time is granted to dispose of the case from today (24.04.2023).
