ORDER : The Court made the following order :- Today, when the matter was taken up for hearing, on the side of the prosecution, it is stated that earlier anticipatory bail petition filed by the petitioner was dismissed by this Court in Crl.OP(MD)No.8207 of 2022, dated 01.08.2022 with the following directions:
"The learned counsel appearing for the petitioner submitted that because of mental and behavioural disorder the petitioner was admitted in Ananthapuri Hospitals and Research Institute, Thiruvananthapuram and now, still is taking treatment for mental illness.
2. In view of the said submission, the question of anticipatory bail may not arise. The custody petition only will lie as per the provision of the Mental Health Act.
3. With the above observation, this Criminal original Petition is disposed of."
