ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 316(2), 318(4) of BNS 2023, in Crime No.446 of 2024 on the file of the respondent police, seeks anticipatory bail. 1/3

2.The case of the prosecution is that the petitioner had induced the defacto complainant and collected a sum of Rs.1,83,000/- from the defacto complainant for the purpose of getting job in abroad and also collected a sum of Rs.1,20,000/- from the relative's of the defacto complainant. Thereafter, the petitioner neither secured job and nor returned the money, which led to the filing of the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offences as alleged by the prosecution. He further submitted that the petitioner is ready and willing to abide by any conditions which may be imposed by this Court. Hence, he seeks anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal Side) submitted that there are 5 previous cases pending against the petitioner similar in nature and the investigation is at initial stage and if the petitioner is released on anticipatory bail, he may abscond. Hence, he opposed for grant of anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case and also the nature of the offence committed by the petitioner and there are 5 previous cases pending against the petitioner and the investigation is still pending and the custodial interrogation is very much required. Further, if the petitioner is released on 2/3

anticipatory bail, he may tamper the witnesses and abscond. Hence, this Court is not inclined to grant anticipatory bail to the petitioner.
