This Writ Petition is filed under Article 226 of the Constitution of India seeking for a direction to the respondent police to grant the permission to conduct the Aadal Paadal programme on 24.08.2023 from 06.00 pm to 11.00 pm in connection with the Thiruvizha of Arulmigu Mutharamman Thirukovil situated at North Subramaniyapuram, Arumuganeri, Thoothukudi District.
2.It is submitted by the learned counsel that the villagers have been conducting the Aadal Paadal programme every year in connection with the Thiruvizha of Arulmigu Mutharamman Thirukovil situated at North Subramaniyapuram, Arumuganeri, Thoothukudi District. However, the respondent police have refused to grant the permission as per proceedings dated 15.08.2023 in C.No.14/F3PS/TUT/2023 for this year without any valid reason. It is submitted that subsequent to the orders passed by this Court in W.P.(MD) No.16224 of 2021, a peace committee meeting was conducted and the issues between the petitioner and the 2/5
rival parties have been resolved and subsequently, there are no issues between the petitioner and the rival parties. 3.The learned Government Advocate (Crl.side) on the other hand submits that in the peace committee meeting, consensus could not be arrived at, thereby the permission was rejected. 4.Considering the submissions made by the learned counsel for the petitioner that in the peace committee meeting, consensus have not been arrived at between the petitioner and the rival parties and that both of them jointly intend to perform the festival, the petitioner is directed to approach the respondent police afresh along with rival parties and file an application jointly, on which the respondent police are directed to consider the same and pass orders appropriately. 5.With the above direction, this Petition is disposed of. No costs. NCC :
