Respondent For Petitioner : Mr.S.Krishnan, Advocate For Respondent : Mr.M.Karunanithi, Government Advocate (Crl.Side) PETITION FOR MODIFICATION Under Sec. 483(1)(b) of BNSS PRAYER :- To modify the condition No.1 imposed by the learned Principal Sessions Judge, Sivagangai vide Crl.M.P.No.1886 of 2025 dated 21.07.2025. ORDER : The Court Made the following order :- This petition has been filed to modify one of the conditions imposed against the petitioner in Cr.M.P.No.1886 of 2025 dated 21.07.2025 by the learned Principal 1/4

Sessions Judge, Sivagangai.

2. The learned counsel for the petitioner submitted that there are four cases pending against the petitioner. This Court had already granted bail to the petitioner by order dated 04.06.2025 in Crl.O.P.(MD)No.8936 of 2025 in connection with Crime No.111 of 2025, and directed the petitioner to appear before the Inspector of Police, Mathagupatti Police Station, Sivagangai District, daily at 10.30 a.m. until further orders. Till date, the petitioner has been regularly complying with the condition imposed by this Court.

He further submitted that by order dated 21.07.2025, the learned Principal Sessions Judge, Sivagangai, granted bail to the petitioner in Cr.M.P.No.1886 of 2025 in connection with Crime No.47 of 2025, and directed the petitioner to stay in Ariyalur District and appear before the Irumbilikurichi Police Station daily at 10.00 a.m. and 05.00 p.m. for a period of 30 days, and thereafter to appear on summons. Since the petitioner has been complying with the condition imposed by this Court, he has been unable to travel from Sivagangai to Ariyalur to comply with the condition imposed by the trial Court. Hence, he prays for modification of the condition imposed by the trial Court.

4. The learned Government Advocate (Criminal Side) appearing for the respondent has not raised any objection to allow this Criminal Original Petition. 2/4

Considering the submissions made by the learned counsel for the petitioner, and being satisfied with the reasons stated above, this Court is inclined to modify the condition imposed on the petitioner in the order made in Cr.M.P.No.1886 of 2025 dated 21.07.2025. Accordingly, the said Condition is modified as follows : 'the petitioner shall report and sign before the Inspector of Police, Mathagupatti Police Station, Sivagangai District daily twice i.e. at 10.00 a.m. and 05.00 p.m. for a period of 30 days and thereafter, the petitioner shall report before the respondent police as and when required for the interrogation.'

6. All other conditions imposed by the trial Court shall remain unaltered.
