ORDER
This writ petition has been filed seeking for issuance of writ of mandamus directing the respondents to settle the insurance amount of Rs.91,000/- to the petitioner which was insured for the rotten crops in application receipt No. 0402332000102038053 and 0402332000102042883 on the land extend of 5 acres and 65.68 cents in Survey No.345/7b, 456/7, 313/4c, 313/1c, 315/76, 324/40 at Moolipatti Village, Virudhunagar Taluk, Virudhunagar District by considering his representation dated 22.08.2024.
2. Heard Mr.SMA.Jinnah, learned counsel appearing for the petitioner and Mr.A.Kannan, learned Additional Government Pleader, who takes notice on 2/5
behalf of the respondents 1 to 4. By consent of both parties, this writ petition is taken up for final disposal at the admission stage itself.
3. The petitioner has been cultivating crops in his own agricultural land. During 2020, due to heavy rain and there was a natural disaster, the crops like cotton and corn farmed in the petitioner's land in Sy.Nos.345/7b, 456/7, 313/4c, 313/1c, 315/76, 324/40 situated at Moolipatti Village, Virudhunagar Taluk, Virudhunagar District, were rotten. The petitioner has applied the insurance for the said crop under the Government sponsored Pradhan Mantri Fasal Bima Yojana Scheme before the fifth respondent herein, by paying a sum of Rs.1209.59/- in application receipt No.0402332000102038053 and Rs.413.77/- in application receipt No.0402332000102042883 on 20.09.2020. Hence, the petitioner submitted representation before the fifth respondent seeking insurance amount of Rs.91,000/- for the said crops. But, the fifth respondent failed to settle the insurance amount till date. Hence, the petitioner is before this Court seeking consideration of his representation.
4. Considering the facts and circumstances of the case and as the writ petition has been filed only to consider the representation of the petitioner, the 3/5
respondents are directed to consider the representation of the petitioner dated 22.08.2024 and pass order on merits and in accordance with law within a period of two months from the date of receipt of a copy of this order.
