ORDER

This Criminal Original Petition has been filed to direct the learned IV Additional District and Sessions Judge, Tirunelveli to expedite the trial in S.C. No.314 of 2022 and dispose the same within a stipulated period prescribed by this Court.

2.When the case came up for hearing on 13.10.2022, this Court has sought for remarks from the learned IV Additional and Sessions Judge, Tirunelveli.

3. The learned IV Additional and Sessions Judge, Tirunelveli had offered remarks. As per his remarks he had assumed office only on 04.08.2022. The sessions case was made over to the Court of the learned IV Additional and Sessions Judge, Tirunelveli and re-numbered as S.C.No.314 of 2022. He further submitted that the prosecution has opened prosecution arguments on 31.10.2022

4. The learned Additional Public Prosecutor would submit that the case stands posted to 11.11.2022 for framing of charges.

5. As per the remarks offered by the learned IV Additional and Sessions Judge, Tirunelveli in letter in D.No.964 of 2022 dated 28.10.2022 already prosecution had commenced opening the prosecution case on 31.10.2022. Therefore in the light of the remarks offered by the 2/4

learned IV Additional and Sessions Judge, Tirunelveli and the submission of the learend Additional Public Prosecutor of this Court, the learned IV Additional and Sessions Judge, Tirunelveli is directed to complete the trial in time. The entire exercise of recording evidence can be completed in one month. Any how the learned IV Additional and Sessions Judge, Tirunelveli is granted two months time to dispose the case in S.C. No.314 of 2022 and report compliance to this Court.

6. With the above direction, the Criminal Original Petition is disposed of.
