ORDER

This petition has been filed seeking transfer of H.M.O.P.NO.270 of 2022 from the file of the Additional Sub Court, Kallakurichi to the file of the (*) Sub Court, Thanjavur.

2.The facts in brief:

The marriage was solemnized between the parties on 21.10.2009. Out of the wedlock they gave birth a female child. Thereafter, due to dispute arose 1/3

between them, the respondent filed the above said H.M.O.P. seeking divorce before the Additional Sub Court, Kallakurichi. Since the petitioner is facing difficulty in attending the above said H.M.O.P. proceedings before the Additional Sub Court, Kallakurichi, this petition has been filed seeking transfer of the same. 3.Heard the learned counsel on either side. The learned counsel for the respondent would submit that the respondent has no objection to transfer the matter to the file of the Sub court, Thanjavur.

4.In view of the above said submission, the H.M.O.P.NO.270 of 2022 filed by the respondent on the file of the Additional Sub Court, Kallakurichi, is ordered to be withdrawn and transferred to the Family court, Thanjavur. 5.Accordingly, this transfer civil miscellaneous petition is allowed.
