Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a writ of mandamus directing the respondents herein to grant permanent status to the petitioner herein with effect from 27.03.1999 award dated 31.08.2015 passed by the fifth respondent herein, in Na.Ka.No.208/2013, with arrears of wages and all other attendant benefits.

This writ petition was filed to issue a direction to implement the order of the Labour Court dated 31.08.2015.

2. The learned counsel appearing for the petitioner as well as the learned counsel appearing for the respondents 1 to 4 would submit that in the present case, the award passed by the Labour Court itself was set aside and the matter was remanded to the Inspector of Labour for passing

orders afresh, by an order of this Court dated 07.03.2022 in W.P. (MD)No.4061 of 2013 and etc. batch. Since the order of the Labour Court has already been set aside, the learned counsels on either side would submit that the prayer in this writ petition cannot be granted.

3. In view of the above submissions, the Writ Petition is dismissed as the prayer cannot be given effect to. No costs. 20.11.2024 NCC:Yes/No Index:Yes/No Speaking/Non-speaking order mbi
