PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the second respondent herein to re-issue the cheque towards Final withdrawal of General Provident Fund amount of Rs.13,000/- with appropriate interest from 13.03.2003 onwards in the light of the proceedings issued by the first respondent in Na.Ka.No.005986/H/E3/2021, dated 06.06.2022. O R D E R

The instant Writ Petition has been filed by a retired Junior Assistant, who was working in the fifth respondent School, seeking a Mandamus to reissue the cheque.

2. According to the learned counsel appearing for the writ petitioner, the petitioner was issued with a cheque for Rs.13,000/- towards Final withdrawal of General Provident Fund, dated 13.03.2003. However, the petitioner has lost the said cheque and it could not be presented before the bank.

3. On instructions, the learned Additional Government Pleader appearing for the respondents 1 to 4 submits that this cheque has not been encashed by the petitioner and it has now lost it validity also.

4. In such circumstances, the second respondent herein is directed to issue appropriate direction to the fourth respondent for issuance of a cheque for an amount of Rs.13,000/-. The said exercise shall be completed within a period of twelve weeks from the date of receipt of a copy of this order.

5. With the above said observations, this Writ Petition stands disposed of. There shall be no order as to costs.
