For Respondent : Mr.P.KOTTAI CHAMY, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.448 of 2021 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/sole accused, who apprehends arrest at the hands of the respondent police, for the alleged offences punishable under Sections 6(a) and 24(1) of Cigarette and Other Tabacco Products Act, 2003 and Section 77 of the Juvenile Justice (Care and Protection of Children) Act, 2015, in Crime No.448 of 2021, seeks anticipatory bail.

2.The case of the prosecution is that on 12.07.2021 at about 10.30 am, some unknown persons sold tobacco to the college students at Hendry Road, Nagercoil. On receiving the secret information, the respondent police rushed to the spot and seized 40kgs of banned tobacco products. Hence, the complaint.

3.The learned counsel appearing for the petitioner submits that this is the fourth petition filed by the petitioner for anticipatory bail. He further submits that the petitioner is in no way connected with the offence and he was wrongly implicated in this case. CRL OP(MD). No.18817 of 2021 4.The learned Government Advocate (Crl.side) submits that earlier petition filed by the petitioner for anticipatory bail were dismissed, considering the gravity of the offence and as on date, there is no change in circumstances.

5.Considering the fact that there is no change in circumstances, after the dismissal of earlier petitions, this Court is not inclined to grant anticipatory bail to the petitioner. 6.Accordingly, the Criminal Original Petition is dismissed. sd/- 14/12/2021 / TRUE COPY / / /2021 Sub-Assistant Registrar (C.S.)
