ORDER

The present Writ Petition has been filed for the issuance of a Writ of Certiorarified Mandamus, to quash the impugned order dated 21.10.2024 and consequently direct the third respondent to issue legal heir certificate to the petitioner, on the basis of his representation dated 15.05.2025.

2. Through the impugned order, the third respondent refused to issue the Legal Heir Certificate stating that the petitioner had approached belatedly.

3. It is an admitted fact that deceased passed away on 11.01.1983. Even though there is a delay in making the application, the respondents cannot refuse to grant Legal Heir Certificate. Accordingly, the impugned order is hereby quashed. The third respondent is directed to conduct an enquiry and thereafter, issue the Legal Heir Certificate, if the petitioner's claim is found to be genuine. 2/4

4. With the above said directions, this Writ Petition is allowed. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed. 06.08.2025 NCC : Yes / No Index : Yes / No Internet : Yes jbr To:
