(R3 & R4 are impleaded vide Court order dated 01.08.2018 in WMP(MD) No.14525 of 2018) PRAYER: Writ Petitions filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents to disburse the insurance/risk coverage amount of Rs.2 Lakhs on account of death of the petitioner's father under Pradhan Mantri Jeevan Jyoti Bima Yojan (PMJJBY) Insurance plan and permit the petitioner to withdraw such amount forthwith from his savings Account No.122701000002837 along with statutory interest till date, without insisting the petitioner to produce any identify proof.

The petitioner's father one Pandy, who is an agriculturist, having a Bank account in the Indian Overseas Bank, 2/7
Mudukkankulam Branch has joined as a member under Pradhan Mantri Jeevan Jyoti Bima Yojan (PMJJBY) Scheme, which was announced by the Hon'ble Prime Minister in the year 2015 for the persons, who are in age group of 18 to 50 years. On 19.05.2017, the petitioner's father died. The petitioner by referring the subscription paid by his father under the Scheme has approached the respondent Bank to disburse the amount as per the scheme. The application of the petitioner was processed and a sum of Rs.2,00,000/- has also been credited to the petitioner's father's account. Thereafter, during the audit made by the Life Insurance Corporation of India, they found that the age of the petitioner's father was 52 years at the time of his enrolment in the Scheme.
Therefore, he is not eligible under the scheme and a direction was issued to the second respondent Bank to freeze the petitioner's father's account and it was freezed. According to the petitioner, the age of the petitioner's father was 49 at the time of enrolment in the Scheme. The petitioner by relying upon the Horoscope of the petitioner's father that the date of birth of the petitioner's father is 15.01.
year 2018 seeking for a Mandamus to direct respondents to disburse the insurance/risk coverage amount of Rs.2 Lakhs to the petitioner. 2.The learned counsel appearing for the petitioner submits that the age of this petitioner's father was 49 at the time of enrolment and he died at the age of 51. However, the respondent claims that the age of the petitioner's father was 52 at the time of enrolment. Hence, a suitable direction may be issued to the respondents to disburse the eligible amount to the petitioner. 3.The learned counsel appearing for the respondents by relying upon the Aathar card and voter ID of the petitioner's father submits that as per the Aathar card, the age of the petitioner's father was 55 years and as per the Voter ID, it was 52 years. He further submits that at the time of enrolment he has mentioned his age as 44 years. Now the petitioner claims that his father's age was 49 at that relevant point of time, that too based on the Horoscope of the petitioner's father.

4.On 02.01.2024, this Court has provided an opportunity to the petitioner to produce the relevant documents to prove his father's age. However, he is not in a position to produce any document.
5.In view of the above, this Court is not inclined to entertain this writ petition. Accordingly, this writ petition is dismissed. No costs.
