Side) For R3 : Mr.R.Jaswanth Ram ***** C O M M O N O R D E R Crl.O.P.(MD) No.19427 of 2025 has been filed seeking to quash the FIR in Crime No.139 of 2025 on the file of the Inspector of Police, Ambathurai Police Station, Dindigul District, registered against the petitioners for the offences punishable under Sections 191(2), 296(b), 115(2), 118(2), 133 and 351(2) of the Bharatiya Nyaya Sanhita (BNS), 2023 and Section 4 of the Tamil Nadu Prohibition of Harassment of Women Act, 2002.

2. Crl.O.P.(MD) No.19698 of 2025 has been filed seeking to quash the FIR in Crime No.138 of 2025 on the file of the Inspector of Police, Page No. 3 of 7

Ambathurai Police Station, Dindigul District, registered against the petitioners for the offences punishable under Sections 191(2), 296(b), 115(2), 118(1) & 351(2) of the Bharatiya Nyaya Sanhita (BNS), 2023 and Sections 3(l)(r) and 3(1)(s) of the Scheduled Caste / Scheduled Tribes (Prevention of Atrocities) Act, 1989.

3. This is a case and a counter-case arising out of the same accident. The gist of the allegations in the FIRs is that during a temple festival, the petitioners in both cases attacked each other and thus committed the aforesaid offences. The third respondent/defacto complainant in Crl.O.P. (MD) No.19698 of 2025 belongs to the Scheduled Caste community.

4. Admittedly, the petitioners and defacto complainant in both cases belong to the same village. The parties have now entered into a compromise and decided to give a quietus to the entire dispute. The parties in Crl.O.P.(MD) No.19427 of 2025 have filed a joint compromise memo dated 12th November, 2025. Since the joint compromise memo could not be filed in Crl.O.P.(MD) No.19698 of 2025, the third respondent/defacto complainant has filed an affidavit stating that he does not wish to pursue the case against the petitioners in the said Crl.O.P. The petitioners in Crl.O.P.(MD) No.19427 of 2025, namely, (1) Balakrishnan [Aadhaar No.7945 6004 6421], (2) Vikram [Aadhaar No. 9536 2152 7827] and (3) Marimuthu @ Dharmar [Aadhaar No.8357 0019 3506], and the second respondent/defacto complainant in Crl.O.P.(MD) No.19427 of 2025, namely, Nagalakshmi [Aadhaar No.3692 7083 5225] are present before this Court in person. The first petitioner in Crl.O.P. (MD) No.19427 of 2025 is the third respondent/defacto complainant in Crl.O.P.(MD) No.19698 of 2025. The parties are identified by Mr.A.Karuppiah, Special Sub Inspector of Police, Ambathurai Police Station. The defacto complainant in both cases confirmed the compromise arrived at between the parties and stated that they do not wish to pursue the cases.

6. Considering the nature of the offences, this Court is of the view that no useful purpose would be served by keeping the First Information Reports (FIRs) pending investigation. Accordingly, the impugned First Information Reports (FIRs) in Crime No.138 & 139 of 2025 on the file of Inspector of Police, Ambathurai Police Station, Dindigul District, are quashed. The petitioners in Crl.O.P.(MD) No.19427 of 2025 shall jointly pay a sum of Rs.5,000/- (Rupees Five Thousand only) and the petitioners Page No. 5 of 7

in Crl.O.P.(MD) No.19698 of 2025 shall jointly pay a sum of Rs.5,000/- (Rupees Five Thousand only), to the Siddha Unit attached to this Court (A/c. No.10767823177, IFSC Code : SBIN0000898 & MICR Code : 625002601) forthwith and file a photocopy of the receipt along with a memo reporting compliance in the Registry. The compromise memo filed by the parties in Crl.O.P.(MD) No.19427 of 2025 and the affidavit filed by the third respondent /defacto complainant in Crl.O.P.(MD) No.19698 of 2025 shall form part and parcel of this order.
