PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of a writ of mandamus directing the respondents to sanction retirement benefits of petitioner's husband and petitioner's family pension and arrears of family pension amount and other benefits along with 6% interest per annum within the time limit that may be fixed by this Court.

ORDER

This writ petition has been filed seeking a mandamus to the respondents to sanction the retirement benefits of the petitioner's husband and other benefits.

2.When this writ petition has been taken up for hearing, the learned Counsel for the 1st respondent submits that the petitioner's husband had earlier filed a writ petition for the very same relief in WP(MD)No.5408 of 2020 and this Court by order dated 16.03.2020 disposed of the writ petition directing the respondents to pay the benefits and as against the said order, the respondents have filed a writ appeal in WA(MD)No.709 of 2023 and the same is pending. 2/4

2.In view of the pendency of the writ appeal in WA(MD)No.709 of 2022, this writ petition is closed and the petitioner shall workout her remedy based on the outcome of the writ appeal.
