O R D E R

The Petitioner herein seeks a direction to the third respondent to conduct proper enquiry on the representation submitted by the petitioner, dated 8.1.2024 seeking cancellation of joint Patta No.1802 and issue separate patta in the name of Petitioner in respect of the property in S.No.260/4 in Kallappanpatti Village, Peraiyur Taluk, Madurai District 2.Mrs.K.Malathi,learned Additional Government Pleader takes notice for the respondents 1 to 3. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.

3.According to the Petitioner, the subject property is his ancestral property and revenue records originally stood in the name of Petitioner's father Perumal Thevar. Now the names of some third parties are included in the revenue records in Patta No.1802. Aggrieved by the same, the Petitioner submitted a representation on 8.1.2024 seeking deletion of the names of third parties and for issuance of patta in the name of the Petitioner. The same has not been considered till date. Hence the Petitioner has 2/6

come before this court with the present writ Petition for the relief stated supra.

4.Mrs.K.Malathi, learned Additional Government Pleader who takes notice for the respondents 1 to 3 would submit that subsequent to the application submitted by the Petitioner, enquiry notice was issued by the third respondent in his proceedings in Na.Ka.No.271/2024/Aa1, dated 20.02.2024 and hence the representation submitted by the Petitioner will be considered on its own merits within the time stipulated by this Court. 5.A perusal of the typed set of papers would indicate that apart from the Petitioner's name, his brother Chinnan's name was also included in joint patta along with other names. The Petitioner in his representation has not stated how he has got exclusive right over the property, after the death of his father Perumal Thevar.

6.In these circumstances, this Court feels that the third respondent shall issue notice to the Patta-holders in Patta No. 1802. Therefore the third respondent is directed to consider the representation of the Petitioner, dated 8.1.2024 and pass final orders on its own merits after issuing notice to the Petitioner and other patta holders in Patta No.1802, within a period of 12 weeks 3/6

from the date of a copy of this order.

7.With the above directions, the Writ Petition stands disposed of. No costs.
