PRAYER : Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a Writ of Mandamus directing the
Respondent No.5 to hand over the Village fund amount and gold ornament to the petitioner for village Temples Repair work for conduct the Kumbabisegam as per Resolution passed by the village people by considering Petitioners Representation dated 22.07.2025 in accordance with law within time stipulated by this Court. ORDER
The present Writ Petition has been filed for the issuance of a Writ of Mandamus, directing the 5th respondent to hand over the Village fund amount and gold ornament to the petitioner for the repair work of the temple and to conduct Kumbabisegam as per Resolution passed by the villagers based on the petitioner's representation dated 22.07.2025.
2. The learned Additional Government Pleader was directed to take instructions, and the case was kept under passover. Upon receiving instructions, the learned Additional Government Pleader submitted that a resolution had been passed by the villagers stating that the 'Kumbabishegam' may be conducted only after the completion of the
repair work. As of now, the repair work has not yet commenced and only preparatory steps have been initiated. Therefore, unless the repair work is completed, the 'Kumbabishegam' cannot be conducted.
3. The issue now appears regarding the collection and utilization of funds. The petitioner has collected a certain amount, and the 5th respondent has collected some amount. Both parties claim that they will carry out the repair work using the funds they have collected. This issue cannot be adjudicated in a writ petition.
4. Therefore, the 2nd respondent/District Revenue Officer is directed to conduct an inquiry after issuing notice to the petitioner, the 5th respondent, and other villagers who are interested parties in this matter. If the District Revenue Officer is able to resolve the dispute between the parties, they shall be at liberty to conduct the 'Kumbabishegam'. Until an order is passed by the District Revenue Officer, the 'Kumbabishegam' shall not be conducted.
5. With these observations, this writ petition is disposed of. No Costs. Consequently, connected miscellaneous petition is closed. 07.08.2025 NCC : Yes / No Internet : Yes KSA
