PRAYER :- For Bail in Crime No.260 of 2022 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioner/sole accused, who was arrested and remanded to judicial custody on 19.08.2022 for the offences punishable under Section 7, 25(1A) of Arms Act, 1959 in Crime No.260 of 2022, on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the petitioner was threatening people with sword and on seeing the respondent, he was trying to escape from the scene of occurrence. Hence the complaint. 3.On the side of the petitioner, it is stated that a false case was foisted against the petitioner. The petitioner is in judicial custody for the past 43 days. Earlier petition filed by the petitioner in Crl.O.P.(MD)No.16066 of 2022, was dismissed on 06.09.2022 and prayed the petitioner to be released on bail. https://www.mhc.tn.gov.in/judis 1/2

No.17448 of 2022 4.On the side of the prosecution, it is stated that the petitioner is having 13 previous cases, out of which, 8 cases are still pending, 5 cases are disposed of, 1 case is a murder case and another case is under Section 307 I.P.C. and the present case is filed under the Arms Act. The investigation is still pending and prayed the petition to be dismissed.

5.Considering the submissions made by both sides and considering the nature of the offences and considering the previous antecedents of the petitioner and also considering the fact that the investigation is still pending, this Court is not inclined to grant bail to this petitioner.

6.Hence, this Petition is dismissed.
