Prayer: Writ Petition is filed under Article 226 Constitution of India, to issue a Writ of Mandamus, directing the third respondent to consider and dispose of the petitioner's complaint dated 22.11.2021 in the light of the Judgment laid down by the Hon'ble Supreme Court of India in the case related to Lalita Kumari Vs Government of Uttar Pradesh and others reported in (2014) 2 SCC 1 without making any unnecessary harassment to the petitioner by the fourth and fifth respondents.

O R D E R

This writ petition has been filed for directing the third respondent to take action on the petitioner's complaint.

2. When the matter was taken up for hearing, the learned Additional Public Prosecutor appearing for the respondents submitted that Crime No.1211 of 2021 was registered on the file of Oddanchathiram Police Station for the offences under Section 147, 294(b) and 323 IPC. The learned counsel for the petitioner states that the petitioner has suffered fracture in the finger and therefore, Section 325 IPC must be invoked. However, as of now proper materials have not been placed before me. I direct the third respondent to gather the necessary particulars in this regard. If the petitioner has suffered any fracture, alteration report will be filed to include Section 325 IPC. It is stated that counter case has been registered in Crime No.1211 of 2021 against the petitioner. It is up to the petitioner to avail the remedies open to him under law. This writ petition is disposed of with the aforesaid direction. No costs.
