ORDER : The Court made the following order :- The petitioner/A2, who was arrested and remanded to judicial custody on 29.05.2024 for the offences punishable under Sections 394 and 302 of IPC, in crime 1/4

No.297 of 2023 on the file of the respondent police, seeks bail. 2.The case of the prosecution is that when the defacto complainant and the deceased were walking on the road, the petitioner and the other accused, who came in a two wheeler are said to have tried to snatch a cell phone of the deceased at knife point. When the same was prevented by the deceased, they stabbed him with a knife at his rib and robbed his cell phone. When the defacto complainant tried to save the deceased, they also stabbed him. On hearing the noise of the defacto complainant, the public gathered, and the accused persons fled away from the scene of occurrence. Hence, the case.

3.Heard both sides.

4.Considering the facts that now the case is pending for committal in PRC.No.41 of 2024 before the learned Judicial Magistrate, Thirumangalam and the petitioner has got two previous cases under the NDPS Act and only for snatching a mobile phone, he alleged to have stabbed the deceased and caused death, for the present, I am not inclined to enlarge the petitioner on bail.

5. In view thereof, the prosecution is directed to bring to the notice of the learned Judicial Magistrate to expedite the process of committal and thereafter also let charges be framed as expeditiously as possible. A copy of this order shall also be produced before the concerned Judicial Magistrate after committal. 2/4
