ORDER

This petition has been filed to cancel the Anticipatory Bail granted in Crl.MP.No.1527 of 2025 on the file of the learned Principal Sessions Judge, Theni District, dated 28.07.2025.

According to the defacto complainant, based on her complaint, FIR was registered against the respondents 2 & 3 in Crime No.335 of 2025 for the offences under Sections 316(2) and 318(4) of BNS, 2023. Thereby, the respondents 2 & 3 approached the learned Principal Sessions Judge, Theni, for anticipatory bail and the same was allowed on 28.07.2025. Thereafter, since they threatened the witnesses, the petitioner lodged a complaint against them and therefore, the respondents 2 & 3 breached the condition imposed by the Court below dated 28.07.2025. Therefore, anticipatory bail granted to the respondents 2 & 3 have to be 2/7

cancelled.

The learned Government Advocate (Crl.Side) would submit that the respondents 2 & 3 were granted anticipatory bail by an order dated 28.07.2025 in Crl.MP.No.1527 of 2025 and imposed condition that the petitioner should report before the respondent police daily at 10.00 a.m for 30 days. As per the order of the Court below, the respondents 2 & 3 are complied with the condition without fail. He would further submit that on the complaint lodged by the petitioner regarding the alleged threat made to the witnesses by the respondents 2 & 3, investigation was conducted and the same was also closed.

4. The learned counsel for the respondents 2 & 3 based on the false complaint lodged by the petitioner in respect of civil dispute, a case has been registered against the respondents 2 & 3. Hence, they approached the learned Principal Sessions Judge, Theni, for anticipatory bail. The learned Principal Sessions Judge, 3/7

Theni, after considering the entire case records, granted anticipatory bail to them and they also complied with the conditions imposed by the learned Principal Sessions Judge, Theni. Thereafter, again the petitioner gave a false complaint against the respondents 2 & 3 that they threatened the witnesses. That complaint was enquired and thereafter, closed by the concerned police. Therefore, there is no breach of condition and there is no ground to cancel the anticipatory bail granted to the respondents 2 & 3 by the Court below dated 28.07.2025.

5. Heard both sides and perused the materials available on record.

In this case, it is admitted fact that based on the complaint lodged by her, a case has been registered against the respondents 2 & 3 and thereafter, the learned Principal Sessions Judge, Theni, granted anticipatory bail to the respondents 2 & 3 by an order dated 28.07.2025. The main ground raised by the petitioner is that 4/7

after releasing on anticipatory bail, the respondents 2 & 3 threatened the witnesses. In this regard, on receipt of complaint given by the petitioner, already enquiry was conducted and closed by the police at the CSR stage and no FIR has been registered against the respondents 2 & 3. Apart from that, there is no material submitted by the learned counsel for the petitioner to substantiate his contention and there is no other ground raised by the petitioner to cancel the anticipatory bail granted to the respondents 2 & 3 herein.

7. Accordingly, the Criminal Original Petition stands dismissed.
