PRAYER :- For Bail in Crime No.3 of 2023 on the file of the respondent police. ORDER : The Court made the following order :- The petitioner/Accused No.1 herein, who was arrested on 10.07.2023 for the alleged offences under Sections 417, 420, 294(b), 506(i) of IPC, in Crime No.3 of 2023, on the file of the respondent police, seeks bail. 2.The case of the prosecution is that the petitioner is the owner of the Cendur Fincorp Finance Limited and the 2nd accused is his wife. Both had approached the defacto complainant and canvassed him to invest in their concern by giving false promise the investment would yield huge profit, believing their words, on various dates the defacto complainant invested huge amount. The defacto complainant's mother and his brother and others also invested huge amount. But, the accused given cheques for the same. When the cheques were presented for payment, they bounced 2/5
as account closed. When they questioned the same, life threat was made by the petitioner. Hence, the complaint.
3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and she has not committed any offence as alleged by the prosecution. But, strong objection was made by the intervenors stating that huge amount is involved.
4. It has been submitted that the entire investigation was transferred to the Economic Offences Wing, Tiruchirappalli, by the order dated 27.07.2023, passed by the Co-ordinate Bench. But, the learned Additional Public Prosecutor submitted that so far the above said order copy was not received by the respondent. So further steps has not been taken by handing over the investigation. Let the above said order be complied.
5.Considering the period of incarceration, this Court is inclined to grant bail to the petitioner with stringent conditions.
6.Accordingly, this Criminal Original Petition is allowed and the petitioner is ordered to be released on bail, on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction 3/5
