PRAYER :- For Bail in Cr.No.875 of 2022 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner/A2, who was arrested and remanded to judicial custody on 13.09.2022 for the offences punishable under Sections 448, 427, 436 and 201 IPC in Crime No.875 of 2022 on the file of the respondent police, seeks bail.
2.The case of the prosecution is that on 11.09.2022, the defacto complainant is working as a Secretary of Thiruvidaimaruthur Primary Co-operative Agriculture and Rural Welfare Bank Limited, Thirupannikottai. On 10.09.2022, the neighbor of the de-facto complainant informed that some miscreants damaged the window and set fire to the office including the files, which was maintained in the office. Since he was travelling towards Dharmapuri, he was not reached the occurrence place and he instructed other employees who rushed to the bank, then they informed to the fire rescue team, https://www.mhc.tn.gov.in/judis 1/2
CRL OP(MD). No.17318 of 2022 thereafter, they reached the spot and brought the fire situation under control. During fire, several files maintained in the office and files connected with Pavundarigapuram Society got completely ablazed worth about Rs.610,000/-/. Hence, the complaint. 3.The learned counsel for the petitioner would submit that the petitioner is working as Clerk, he was falsely implicated as an accused in this case. He would further submit that the petitioner is in judicial custody from 13.09.2022 and hence, he prays for bail. 4.The learned Additional Public Prosecutor appearing for the respondent police would submit that the petitioner is the Clerk of Thiruvidaimarudur Primary Agricultural Co-operative Society and set fire in the ledgers, which was seized by the inquiry officer with regard to inquiry.
In this case, investigation is not yet completed. Hence, he strongly opposed to grant bail. 5.Considering the gravity and nature of the offence and also considering the damage of the property and also the fact that the investigation is not yet completed, this Court is not inclined to grant bail to the petitioner.
