Respondent Prayer: Petition filed under Article 226 of the Constitution of India, praying for issuance of Writ of Mandamus, directing the respondent herein to grant patta in the petitioner favour in respect of the petitioner's property comprised in S.No.297/17, 297/16 of a total extent of 5 cents situated at Tenkarai Village, Periyakulam Taluk, Theni District on the basis of the petitioner's online application, dated 26.12.2022 vide Nos. 2022/0103/25/084483, and dated 24.12.2022, 0-2022/0103/25/084430 and also by considering the petitioner's representation, dated 18.06.2024 within a time stipulated by this Court.

ORDER

The petitioner has approached this Court by filing a mandamus for a direction to the respondent to dispose of the petitioner's online application and grant patta in respect of the property comprised in S.Nos.297/17 and 297/16 measuring a total extent of 5 cents.

2. The petitioner has purchased the above said property under a registered sale deed, dated 01.12.2005 from one Gnana Selvaraj and Xavier Jeyaraj. The petitioner who was in peaceful possession and enjoyment of the property had made an application on 19.07.2024 for grant of patta to the respondent. However, the respondent has not taken any action which is causing a great hardship to the petitioner. Therefore, the petitioner is before this Court.

3. The learned Additional Government Pleader informed that payment made on 24.12.2022 shall be treated as payment made for the

present representation and orders will be passed without insisting fresh payment.

4. Heard the learned counsel on either side.

5. The petitioner had made an online application on 24.12.2022 and also had submitted a representation on 18.06.2024. However no action has been taken on the same. Therefore, a mandamus is issued to the respondent to consider the petitioner's online application, dated 24.12.2022 and the representation, dated 18.06.2024 without insisting on fresh payment and pass orders within a period of six (6) weeks from the date of receipt of copy of this order.

6. With the above directions, this Writ Petition stands allowed. No costs.
