The above petition has been filed seeking orders to restore the appeal in S.A(MD)No.436 of 2023, which was dismissed for default on 01.08.2024.

2. Heard the learned counsel for the petitioner and the learned counsel appearing for the respondents 1 to 3.

3. It is seen from the records that the petitioner's earlier application to condone the delay in filing restoration petition was allowed. Considering the facts and circumstances of the case and also the reasons assigned, this Court is inclined to allow this petition.
