PRAYER :- For Bail in Crime No.717 of 2023 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioner/1st Accused, who was arrested on 20.07.2023 for the alleged
offence under Sections 3(2)(a), 4(2)(a), 4(2)(c), 5(1)(a) and 5(1)(d) of Immoral Traffic (Prevention) Act, 1956 and under Section 370A(2) of IPC, in Crime No.717 of 2023, on the file of the respondent police, seeks bail. 2.The case of the prosecution is that on secret information received by the respondent Police that brothel is conducted at Riyan Guest House, Mahabooppalayam, the defacto complainant and his Police Team went to the place of occurrence and they found eight female in the said premises and they have told that they were forcibly involved in prostitution in the said premises by the accused persons. It is further alleged that 4th accused is the owner of the said premises and accused Nos.1 to 3 are brokers and accused No.6 is the lease holder of the said premises. Hence, the complaint.
3.The learned counsel for the petitioner would submit that the petitioner is an innocent and he is no way connected with the alleged occurrence. He was only working in the above said hotel. He is in custody from 20.07.2023. Hence, prays to release him on bail.
4.The learned Additional Public Prosecutor appearing for the respondent would submit that the petitioner is not having any previous case at his credit. The coaccused in this case has been released on by this Court.
5.Considering the facts and circumstances of this case, that the petitioner is not having any previous case at his credit and considering the period of incarceration, this Court is inclined to grant bail to the petitioner with certain conditions. 6.Accordingly, this Criminal Original Petition is allowed and the petitioner is ordered to be released on bail, on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.5, Madurai, and on further condition that the petitioner shall report before the respondent police daily at 10.30 a.m. until further orders.
