O R D E R

[Order of the Court was made by A.D.JAGADISH CHANDIRA, J.] This habeas corpus petition is filed seeking a direction to the respondents 1 and 2 to produce the person or body of the detenue, namely, Sneha, W/o.Jeyamani, aged about 22 years and her minor son, namely, Kuttymani, aged about 1 1⁄2 years and set them at liberty.

2.It is the case of the petitioner that his second daughter, Sneha was married to one Chinnachamy of Peyampatti Village and that she got one male child aged 1 1⁄2 years. While so, on 21.05.2025, the petitioner's daughter had informed her husband that she is leaving to the her parental house along with the child and it was also intimated to the petitioner also. However, the petitioner's daughter did not come to his house and she also did not return to her husband's

house. The petitioner and his son-in- law had searched his daughter and the child. However, they were not found. Thereby, the petitioner lodged a complaint before the second respondent police and a case in Crime No.87 of 2025 was registered on 04.06.2025. However, till date no action has been taken by the respondents to trace and secure the missing persons. Hence, the petitioner has come up before this Court with this Habeas Corpus Petition. 3.When the matter is taken up today, the learned Additional Public Prosecutor would submit that the missing person is the daughter of the petitioner. Based on the complaint given by the petitioner, the case in Crime No. 87 of 2025 has been registered by the Vilampatti Police on 04.06.2025.

Simultaneously, the petitioner's son in law, Chinnasamy has also given a complaint before the Sindupatti Police Station, Madurai, based on which, the case in Crime No.90 of 2025 has also been registered for women missing and boy missing. He would further submit that during course of investigation, it has come to light that the petitioner's daughter had gone along with her friend on her own volition and that respondents are taking steps to trace the missing persons.

missing persons, Crime No.87 of 2025 will be closed and the complaint in Crime No.90 of 2025 registered on the file of the Sindupatti Police Station will continue to be investigated.

4.In view of the finding that the petitioner's daughter is not on illegal detention, this Court directs the Inspector of Police, Sindupatti Police station, Madurai, to continue with the investigation in the case in Crime No.90 of 2025 and the investigation shall be monitored by the Deputy Superintendant of Police, Thirumangalam.
