ORDER

This Writ Petition is disposed of at the time of admission with the consent of the learned counsel for the petitioner, the learned Central Government Standing Counsel for the first respondent and the learned Government Advocate (Crl.Side) for the second respondent.

2. The petitioner has applied for a fresh passport on 04.01.2025 vide passport application No.(ARN). 25-1000144943.

3. The learned counsel for the petitioner submits that the petitioner was arrayed as an accused person in Crime No.216/2020 before the second respondent for the offences under Sections 341, 294(b), 323 and 506(i) IPC.

4. The learned Government Advocate (Crl.Side) for the second respondent confirms the same and submits that a charge sheet was filed before the Judicial Magistrate Court, Kadaladi and the same has been taken on file pursuant to which 2/4

a criminal case has been registered against the petitioner and others in C.C.No. 164 of 2022. The case is listed today i.e., 07.08.2025 for recording evidence.

5. Considering the fact that the petitioner is already involved in a criminal case, there is no scope for any positive direction at this stage. However, it is open for the petitioner to move an appropriate application at the appropriate stage of the case to enable the first respondent to process the passport application. Since the passport application was filed on 04.01.2025, the same may be closed pending receipt of a favourable order from the concerned Court.

6. In case the petitioner secures any favourable orders from the concerned Court, the petitioner may file a fresh application to the first respondent to process the same and to issue a fresh passport to the petitioner.

7. With the above liberty, this Writ Petition is disposed of. No costs. Index : Yes / No 07.08.2025 Internet : Yes / No apd 3/4
