ORDER
The present writ petition is filed for a mandamus to the respondents to conduct enquiry and pass an order pursuant to the petitioner,s representation, dated 02.08.2024.
2. The petitioner's father Veeranambalam owned an extent of 8.40 acres in Survey No.957/A4 in Anjuguzhipatti village, Dindigul taluk,
Dindigul district which was his ancestral property. The revenue records are stood in the petitioner's father name and patta was granted to him in patta no.1021. The said Veeranambalam died on 01.11.2012 leaving behind his 4 sons and two daughters. The petitioner and his father had sold the land in Survey No.957/A4 measuring an extent of 1 acre 50 cents to one Palaniammal under a registered sale deed, dated 13.12.1982. On 31.10.2011, the said Palaniammal w/o late.Ramasamy Reddiyar executed a registered sale deed in favour of the petitioner and the petitioner's father to an extent of 1 acre 10 cents. On the same day, the Palaniammal w/o late.Ramasamy Reddiyar had executed a sale of the remaining 40 cents to one Angammal w/o Pappu Reddiyar.
The said Angammal had thereafter executed a settlement deed in favour of Velusamy in respect of an extent of 54 cents in Survey No.957/4A, despite the fact that she had only been allotted an extent of 40 cents. Thereafter, the said Angammal had executed 4 settlement deeds in favour of her sons and had practically created documents in respect of the entire extent. Therefore, the petitioner on coming to know about the fraudulent activities being carried out, had made a representation, dated 02.08.
before the respondents to cancel the patta. However, no steps have been taken. Therefore, the petitioner is before this Court.
3. Heard the learned counsel on either side and perused the records.
4. Considering the above facts, a mandamus is issued to the respondents 1 to 3 to consider the representation of the petitioner, dated 02.08.2024 and pass orders within a period of eight (8) weeks from the date of receipt of copy of this order.
5. With the above directions, this Writ Petition stands allowed. No costs.
