ORDER : The Court made the following order :- The petitioner/Sole accused who apprehends arrest at the hands of the respondent police for the offences punishable under sections 294(b) & 506(ii) of I.P.C., in Crime No.Not Known of 2023 on the file of the respondent police, seeks anticipatory bail. 1/3

2.The case of the prosecution is that the defacto complainant lodged a complaint before the respondent police stating that the petitioner has borrowed a sum of Rs.5,00,000/- from her as hand loan and also 19 sovereigns of gold jewels. When she demanded return the above, he paid only Rs.4,25,000/- alone. But, so far not returned the balance amount, but threatened the defacto complainant with dire consequences.

3.The learned Additional Public Prosecutor would submit that based on the complaint given by the defacto complainant enquiry is going on. He would further submit that in spite of repeated summons, it could not be served upon the petitioner. Therefore, they could not complete the enquiry on the complaint. 4.The learned counsel for the petitioner would submit that he is very much available in the Village itself. He being the Village Panchayat President, there is no question of absconding.

5.Let the above said summon be served upon the petitioner through his counsel. Let the petitioner appear before the respondent police on 28.08.2023. Let the 2/3

enquiry be completed by the respondent police within a period of fifteen days from the date of appearance of the petitioner. It is made clear that the petitioner should not approach this Court repeatedly.

6.With the above said directions, this criminal original petition stands disposed of.
