O R D E R

This writ petition has been filed challenging the impugned order dated 29.11.2019 passed by the respondent rejecting the petitioner's request for 1/4

compassionate appointment on the ground that he is a minor and therefore, he is not entitled to get compassionate appointment as per G.O.(Ms).No.155, Labour and Employment Department, dated 10.12.2014.

2. This Court had directed the learned Standing Counsel appearing for the respondent on the last hearing date, to produce G.O.(Ms).No.155, Labour and Employment Department, dated 10.12.2014. Accordingly, the learned Standing Counsel has produced G.O.(Ms).No.155, Labour and Employment Department, dated 10.12.2014 today. As seen from the same, the said Government Order comes into effect from 04.05.2010. Admittedly, the petitioner was a minor when his grandmother submitted the application for compassionate appointment with the respondent on 07.08.2012. The petitioner was aged 11 years at that point of time. As seen from G.O.(Ms).No.155, Labour and Employment Department, dated 10.12.2014 referred to supra, it is clear that the employment for a minor on compassionate appointment cannot be considered, as he is not eligible.

Only due to the fact that the petitioner was a minor at the time when his grandmother had submitted the application for compassionate appointment on 07.08.2012 on account of the death of the petitioner's father while he was in service, the respondent / Board has rightly rejected the request for compassionate appointment to the petitioner.

3. This Court does not find any infirmity in the impugned order, since the same has been passed only in accordance with G.O.(Ms).No.155, Labour and Employment Department, dated 10.12.2014.

4. Accordingly, there is no merit in this writ petition and the same stands dismissed. No costs.
