Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, for issuance of a Writ of Mandamus, directing the respondents herein to implement and enforce the service rules issued by the 1st respondent in G.O.Ms.No.34 dated 17.02.2015 and consequent clarification in Government Lr.No. 344437/AA3/2013/MG, dated 24.03.2015 and consequently direct the respondents herein not to effect any temporary promotion to the post of Assistant Executive Engineer violating the service rules. 1/4

ORDER

This writ petition is filed for Mandamus, seeking direction to the respondents to implement the G.O., in G.O.Ms.No.34 and consequential clarification of the letter of the Government.

2. The similar issue was considered by the Hon'ble First Bench of this Court in W.P(MD)Nos.27211, 15795, 15493, 15739 and 17532 of 2015, vide order dated 24.08.2022, the writ petitions were disposed of. Aggrieved over the same, the Engineers Graduates Association has preferred SLP and the same is pending before the Hon'ble Supreme Court.

3. Since the the Hon'ble First Bench of this Court has disposed of the earlier writ petitions, following the same the instant writ petition is also disposed of. However, the petitioner's right will be considered after disposal of the SLP. 2/4
