ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offence punishable under Section 420 of IPC, in Crime No.Not known of 2021, seeks anticipatory bail. 2.The learned Government Advocate would submit that based upon the complaint given by the defacto complainant, enquiry was undertaken. Even though summon was issued, the petitioner has not turned up. The petitioner is not co-operating with the respondent for enquiry. The matter cannot be kept pending. Let the petitioner appear before the respondent Police and co-operate for the enquiry. If any trouble arises during the course of enquiry, she can workout her remedy through appropriate proceedings.
3.The learned counsel for the petitioner would submit that on 08.10.2018, undertaking has been given by the defacto complainant to the effect that the entire amount of Rs.2,75,000/- has been received. Documents which have been executed in respect of the above said proceedings were also handed over to Vijayakumar, who is the husband of this petitioner.
4.Now, the grievance of the petitioner is that, after the above said undertaking letter, the present complaint has been given by the defacto complainant stating that the amount has not been settled by https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL OP(MD). No.18749 of 2021 this petitioner. When such document is available with the petitioner, she can very well appear before the respondent Police and co-operate with the enquiry officer to complete the enquiry. If any trouble arises during the course of enquiry, she can workout her remedy through appropriate proceedings.
