2.The learned counsel appearing for the petitioners seeks permission of this Court to withdraw the review application in 25/29
Rev.Aplc.(MD)No.178 of 2025 alone. He has also made an endorsement to that effect. Recording the same, the application in Rev.Aplc.(MD)No.178 of 2025 is dismissed as withdrawn. 3.The learned counsel for the petitioners submits that though this Court has accepted the case of the petitioners in Rev.Aplc.(MD)Nos.179 to 199 of 2025 in the light of the findings of the judgments passed by this Court in WA.SR.(MD)No.40406 of 2010 dated 28.01.2011 and WA.(MD)Nos.776 to 778 of 2011 dated 29.09.2015 and issued a direction to the Transport Corporation to consider the case of the petitioners under the Madras Liberalized Pension Rules, 1960, the Transport Corporation cannot pay the pension and the Government has to pay the same. Therefore, the learned counsel for the petitioners seeks to review the earlier order passed by this Court by issuing direction to the Government instead of Transport Corporation. 4.The learned counsel appearing for the Transport Corporation also admits the above said submission. 26/29
5.The learned counsel appearing for the petitioners submits that the petitioner in Rev.Aplc.(MD)No.194 of 2025 is in a different footing than the other petitioners. According to him, she has already opted with regard to the eligibility under the Madras Liberalized pension Rules and it has not been disputed by the Transport Corporation and hence, there need not be any consideration by the Government in her case. Hence, the learned counsel submits that there shall be a direction to the Government to pay pension.
6.Considering the rival submissions, these review applications in Rev.Aplc.(MD)Nos.179 to 199 of 2025 are disposed of and the earlier direction issued by this Court is modified to the effect that the petitioner in Rev.Aplc.(MD)No.194 of 2025 is entitled for pension under the Madras Liberalized Pension Rules 1960 and therefore, Government, viz., the Secretary to Government, Transport Department, Chennai has to consider the case of the petitioner and take decision, within a period of four weeks from the date of receipt of a copy of this order. With regard to the other petitioners, the Secretary to 27/29
Government, Transport Department, Chennai has to take a call as per the judgments passed by this Court in WA.SR.(MD)No. 40406 of 2010 dated 28.01.2011 and WA.(MD)Nos.776 to 778 of 2011 dated 29.09.2015, within a period of eight weeks from the date of receipt of a copy of this order. The Transport Corporation shall also provide necessary documents to the Government enabling the Government to take a decision at the earliest. No costs.
