The present writ petition has been filed seeking for a Writ of Mandamus, directing the respondents No.1 and 2 to transfer the CTV License Registration standing in the name of the petitioner's son to be transferred in the name of the writ petitioner.
2. According to the petitioner, originally CTV license name was standing in the name of her son, namely, V.Prakash who had passed away on 10.06.2014. Hence, she had made a representation to the second respondent to transfer the said license in her name. Since the said request was not considered, the present writ petition has been filed.
3. The learned counsel for the respondents No.1 and 2 had filed a counter affidavit and contended that there is no provision for transfer of license. A license is granted to an individual. In case, if the individual had passed away, only a fresh license has to be obtained in the name of the legal heir. In view of the said legal position, I find that the request of the petitioner for transfer of license in her name does not arise. Hence, 3/5
this writ petition is liable to be dismissed. However, the petitioner is at liberty to apply for a fresh license before the second respondent.
4. With the above said observations, the Writ Petition stands dismissed. No costs. Consequently, connected miscellaneous petition is closed.
