The Civil Miscellaneous Petition has been filed seeking orders to condone the delay of 138 days in filing the appeal against the award, dated 06.11.2024 made in M.C.O.P.No.243 of 2016 on the file of the Motor Accident Claims Tribunal cum Additional Subordinate Judge, Tenkasi.

2. Heard the learned counsel for the petitioner as well as the learned counsel appearing for the respondents and also perused the records.

3. The learned counsel for the petitioner would submit that the appellant has already deposited the entire award amount before the Tribunal.

4. Considering the reasons assigned and also taking note of the fact that the entire award amount has already been deposited, this Court is inclined to condone the delay. Accordingly, this petition is ordered and the Registry is directed to take the appeal on file, if it is otherwise in order and list the matter in the usual course.
