The Writ Petition is filed seeking a direction to the respondents to conduct survey of the properties in S.Nos. 287/3,287/4,287/5,290/2, 290/3, 294/11,299/9,300/1, 302/11, 302/2, 302/7,303/1,303/7,303/8,304/2,305/1,305/11,305/5,305/8,308/2, 324/2,324/4,329/12 situated at Neduvayal Village, Singampunari Taluk, Sivagangai District by considering his application, dated 24.04.2025.
2.Mrs.K.Malathi, learned Additional Government Pleader takes notice for the respondents 1 and 2 and Mr.M.Vaikkam Karunanithi, learned Government Advocate(Crl.side) takes notice for the third respondent. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself. 2/5
3.According to the Petitioner, he is the owner of the subject properties and the revenue patta stands in his name in Patta No. 1988. The Petitioner had submitted an application on 24.04.2025 seeking survey of the subject properties. The same has not been considered so far. Hence the Petitioner is before this Court with the present Writ Petition for the relief stated supra. 4.Mrs.K.Malathi, learned Additional Government Pleader who takes notice for the respondents 1 and 2 would submit when the respondents 1 and 2 attempted to survey the properties based on the application submitted by the Petitioner, there was objection by the neighbouring land owners and the process of survey could not be conducted.
5.In view of the same, without expressing any opinion on the merits of the matter, the first respondent is directed to consider the application of the Petitioner, dated 24.04.2025 and pass final orders on its own merits after issuing notice to the Petitioner, neighbouring land owners and other interested parties, if any, within a period of 12 weeks from the date of a copy of this order. 6.With the above directions, the Writ Petition stands disposed of. No costs.
