ORDER
The petitioner herein seeks a direction to the respondents to consider her representation dated 13.02.2024 and to modify the classification of the revenue records in respect of the lands in Survey No. 204/2 by deleting the entry as "Government land" and include the names of the petitioner and her husband.
2.Heard the arguments of Mr.K.Vanchinathan, learned counsel appearing for the petitioner and Mrs.K.Malathi, learned Additional Government Pleader appearing for the respondents. By consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.
3.According to the petitioner, the properties situated in Survey No. 204/2 were purchased by her and her husband under four sale deeds dated 08.08.2006, 09.03.2005, 12.09.2007 and 20.09.2007. However, in the revenue documents, the properties have been wrongly classified as "Government land" instead of patta land in the names of the petitioner and her husband. Hence, the petitioner submitted a representation before the respondents on 13.02.2024, seeking rectification of the revenue records and issuance of patta in the names of the petitioner and her husband. The same has not been considered. Hence, the petitioner has come before this Court.
4.The learned Additional Government Pleader appearing for the respondents would submit that the competent authority to consider the request for change of classification is the District Revenue Officer and the petitioner has not submitted any representation before the competent authority.
5. In view of the same, without expressing any opinion on the merits of the matter, the third respondent is directed to forward the
representation of the petitioner to the competent authority, namely, District Revenue Officer, Madurai, within a period of two weeks from the date of receipt of a copy of this order. The said authority shall consider the representation of the petitioner and pass final orders on its own merits, within a further period of twelve weeks, after affording reasonable opportunity to the petitioner and other interested parties. Accordingly, this Writ Petition is disposed of.
