ORDER : This Court made the following order :- The petitioner/Sole accused, who was arrested and remanded to judicial custody on 14.06.2025 for the offences punishable under Sections 194 BNSS @ 103(1) of BNS, in Crime No.222 of 2025 on the file of the respondent police, seeks bail. 2.The case of the prosecution is that the marriage between the defacto complainant's younger daughter and the petitioner was solemnized 11 years ago. On 12.06.2025 at about 04.30 pm, the deceased's daughter informed to the defacto complainant stating that her mother committed suicide by hanging. Further, the defacto complainant has lodged a complaint before the respondent and the same was investigated by the respondent police, it reveals that the petitioner has strangulated the neck of the deceased and hanged her with the help of the saree. Hence, the complaint.

3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. The petitioner is the husband of the deceased and having two children and he is 50% disabled person. He further submitted that the petitioner's earlier bail application in Crl.O.P(MD)No.12043 of 2025 was dismissed and the this is the second bail application. The petitioner is ready and willing to abide any conditions that may be imposed by this Court.

4. The learned Government Advocate (Criminal Side) submitted that the petitioner is the husband of the deceased and the defacto complainant is the mother of the deceased. The deceased was having extra marital affair with another person, eloped with him and stayed at Trichy. Thereafter, the family members advised her and subsequently, the deceased came to the petitioner's house on 12.06.2025. When the accused asked for water from the pot, the deceased quarreled with him. As a result, the accused attacked the deceased with his hands, causing her to fall down and lose consciousness. After that petitioner has strangulated the neck of the deceased and hanged her with the help of the saree. He further submitted that the investigation is pending. Hence, he opposed to grant bail to the petitioner. 5.

Taking into consideration of the facts and circumstances of the case and considering the fact that the occurrence had taken place on 12.06.2025, by this time most of the investigation might have been completed and taking note of the fact that the petitioner remanded into judicial custody on 14.06.

6. Accordingly, the petitioner is ordered to be released on bail on executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two 3/6

sureties, each for a like sum to the satisfaction of learned Judicial Magistrate, Sankarankovil, Tenkasi District and on further conditions that :- [a] the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity.

[b] The petitioner shall furnish his residential address and contact number to the learned Judicial Magistrate, Sankarankovil, Tenkasi District. If the petitioner changes his residential address, he shall report the same to the learned Judicial Magistrate, Sankarankovil, Tenkasi District;

[c] the petitioner shall appear and sign before the respondent police daily at 10.00 a.m., until further orders.

[d] the petitioner shall not abscond either during investigation or trial. [e] the petitioner shall not tamper with evidence or witness either during investigation or trial.

[f] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560]. 4/6

[g] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 BNS.
