The relief sought for in the present writ petition is for a direction to the third respondent to sponsor the name of the writ petitioner bearing registration No.TTD1999F00003642, dated 25.06.1999, to the second respondent and to direct the second respondent to consider her candidature to the post of Pharmacist.

The learned Additional Government Pleader appearing for the respondents 1 and 3 brought to the notice of this Court that as per the letter issued by the Executive Engineer, Public Works Department, Madurai, to the District Employment Officer, Thoothukudi, vide proceedings, dated 02.09.2014, the writ petitioner was already appointed as Junior Assistant in the Public Works Department, Thoothukudi Sub-Division.

When the writ petitioner was admittedly appointed as Junior Assistant in the Public Works Department, she cannot file a writ petition seeking for a direction to the authority concerned to sponsor her name for the post of Pharmacist. Once an order of appointment is issued and the appointment is accepted by the candidate, then the name of the candidate is to be deleted from the register maintained by the Employment Exchange concerned and therefore, the very relief sought for in the present writ petition is absolutely misconceived and such a relief cannot be granted at all. The fact remains that even before filing of the present writ petition in the year 2015, the writ petitioner was appointed as Junior Assistant in the Public Works Department. This being the factum, the relief as such sought for in the present writ petition cannot be granted.
