PRAYER:- Petition - filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the respondents to disburse the amount for a sum of Rs.5,00,000/- for the works done by the petitioner on the basis of contract as per Kadayam Panchayat union resolution Na.Ka.No.A3/2861/2016 and Manthiyur village panchayat resolution Na.Ka.No.A3/2258/2014 panchayat works on the basis of the petitioner's representation dated 16.11.2019 within time frame fixed by this Court.

ORDER

This writ petition has been filed for issuance of writ of mandamus directing the respondents to act upon the representation made by the petitioner on 16.11.2019, wherein the petitioner is seeking for disbursement of the amount payable to him for the works done by him on the basis of the contract given by the Panchayat Union.

2. The grievance of the petitioner is that the Panchayat Union had allotted the work to the petitioner by entering into a contract and the petitioner had also completed the work. According to the petitioner, a sum of Rs.5,00,000/- was due and payable to the petitioner and the said amount was not paid. The petitioner made a representation in this regard and since the same was not considered, the present writ petition has been filed before this Court. 2/4

3. Heard Mr.V.Mayakannan, learned counsel appearing on behalf of the petitioner, Ms.D.Farjana Ghoushia, learned Special Government Pleader for the first respondent and Mr.T.Amjad Khan, learned Government Advocate appearing for the respondents respondents 2 and 3.

4. Taking into consideration the facts and circumstances of this case and the materials placed before this Court and the relief sought for in this writ petition, there shall be a direction to the second respondent to deal with the representation made by the petitioner. Whatever amount is due and payable to the petitioner for the works done by him as per the available records shall be settled to the petitioner within a period of six weeks from the date of receipt of a copy of this order.
