PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus or any other writ or direction in the nature of writ directing the respondent No.4 to survey the land to the petitioner with adequate police protection in the Survey No. 59(1A2B) and 60(1B2B2) which is situated in Vilathikulam Village, Vilathikulam Taluk, Tuticorin District by considering the petitioner's representation dated 21.07.2025.

The petitioner herein seeks a direction to the fourth respondent to survey the property situate in S.Nos.59(1A2B) and 60(1B2B2) in Vilathikulam Village, Vilathikulam Taluk, Tuticorin District by considering his representation dated 21.07.2025. 2/6
2.Mr.D.S.Nedunchezian, learned Government Advocate takes notice for the respondents 1 to 4. Mr.M.Vaikkam Karunanithi, learned Government Advocate (crl.Side) takes notice for the fifth respondent. By consent of both parties, the writ petition is taken up for final disposal at the admission stage itself.
3.According to the petitioner, the subject property was alloted to him through family partition and the patta for property in S.No.59(1A2B) stands in his name and patta for the property situate in S.No.60(1B2B2) stands in the name of the petitioner and his brother Sakthivel. He submitted two applications on 11.07.2025 and 19.07.2025 seeking survey of the subject properties in application Nos.2025/0123/28/008692 and 2025/0123/28/008860. The said applications were not considered. Hence, he has come before this Court.
4.The learned Government Advocate who takes notice for respondents 1 to 4 would submit that the applications submitted by the petitioner will be considered in accordance with the law. 3/6
5.In the view of the same, without expressing any opinion on the merits of the matter, the respondents 3 and 4 are directed to consider the applications of the petitioner dated 11.07.2025 and 19.07.2025 and pass final orders on its own merits within a period of twelve weeks from the date of receipt of a copy of this order, after issuing notice to the petitioner, his brother Sakthivel, neighboring land owners and other interested parties.
6.With the above direction, this writ petition stands disposed of. No costs.
