Order : This Criminal Miscellaneous Petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.RAMSUNDARVIJAYRAJ.S, Advocate for the petitioner and of MR.A.THIRUVADIKUMAR, Additional Public Prosecutor on behalf of the Respondent, the court made the following order:- [Order of the Court was made by A.D.JAGADISH CHANDIRA, J.] Seeking to suspend the sentence imposed on the petitioner by the learned Sessions Judge, Mahila Court, Tiruchirappalli, vide order dated 16.09.2021 in S.C.No.52 of 2018, he has filed this criminal miscellaneous petition.
2. Heard the learned counsel on either side.
3. This is the second application for suspension of sentence. The earlier application in Crl.M.P.(MD) No.4804 of 2022 filed by the petitioner for suspension of sentence came to be dismissed as withdrawn by order dated 21.06.2022. 2/4
4. Having gone though the accompanying affidavit and the records, we find that this is not a fit case for grant of suspension of sentence to the petitioner at this stage.
5. Hence, this criminal miscellaneous petition is dismissed.
