(Order of the Court was made by PUSHPA SATHYANARAYANA,J.) The Writ Petition has been filed by the petitioner seeking for issuance of a Writ of Mandamus, forbearing the Respondents herein from granting FL2/FL3 license under Tamilanadu Liquor (License and Permit) Rules, 1981 to any person for establishing a private liquor shop and bar situated at S.No.234/1A2, C.Pudupatti Village, Cumbam Main Road, near City Union Bank, Uthamapalayam Taluk, Theni District.

W.P(MD)No.21518 of 2021 2.Mr.B.Saravanan, learned Additional Government Pleader, who accepts notice on behalf of the respondents, has furnished copies of the proceedings of the District Collector, the second respondent, as per which, one M/s.Friends Sports & Recreation Club - Usilampatti, has been given FL2 bar licence. The Commissioner of Prohibition and Excise, Chepauk, Chennai - 600 005, also in his proceedings R.DIS.No.P&E.2(1)/3670/2021, dated 25.11.2021, had granted a new licence in Form F.A.12 under the rule provision of the Tamil Nadu Liquor (Licence and Permit) Rules, 1981.
3.In view of the above, the prayer sought for has become infructuous. If at all the petitioner is aggrieved, it is open to him to challenge the licence already granted. 4.The Writ Petition stands dismissed with the above observations. No costs.
Consequently, connected Miscellaneous Petition is also closed.
