Heard the learned counsel on either side.
2. The learned counsel appearing for the petitioner informs the Court that the petitioner has passed away one year back. Steps have not been taken in time for bringing the legal heirs on record.
3. What is under challenge in this writ petition is only a notice. No formal order had been passed. Therefore, the question of interference may not really arise. 2/4

4. The learned counsel appearing for the petitioner informs the Court that similarly placed persons have filed W.P. (MD)No.8769 of 2015 and the same was allowed on 07.09.2023.
5. The petitioner was working as watchman in SIDCO. An old tenement was allotted to him. The scheme contemplates extension of benefit even to the legal heirs of a retired employee. Liberty is given to the legal heir of the writ petitioner to submit a representation to the second respondent. If any such representation is filed, the same will be disposed of by the second respondent on merits and in accordance with law in the light of the order dated 07.09.2023 made in W.P.(MD)No.8769 of 2015.
6. This writ petition stands disposed of accordingly. No costs. Consequently, connected miscellaneous petitions are closed.
